Trump Administration Threatens School Funding Over Transgender Policy

SouthernWorldwide.com – The Trump administration has signaled its intent to take enforcement action, which could involve withholding federal funding, against Kansas City, Kansas Public Schools. This action is a direct response to the district’s policies concerning transgender students, which the administration asserts prevent staff from informing parents about a transgender student’s gender identity.

The Department of Education stated that the Kansas City, Kansas Public Schools’ policy of not disclosing a student’s transgender status to their parents constitutes a violation of the Family Educational Rights and Privacy Act (FERPA).

In conjunction with the Department of Justice, the Education Department announced it would be pursuing “appropriate enforcement measures.” These measures could include judicial proceedings and, ultimately, the potential loss of federal funding for the school district.

Frank Miller, Director of the Student Privacy Policy Office at the Education Department, commented on the situation. He stated that the school district’s “sustained efforts to sidestep FERPA, conceal its true policies, and obstruct parents’ lawful access to their children’s education records represents a serious and deliberate breach of federal law.”

Miller further emphasized the importance of a robust enforcement partnership. “A strong and coordinated enforcement partnership between the Department of Education and the Department of Justice will ensure districts are held accountable and fully honor parents’ rights,” he added.

According to the government’s assessment, the district’s policy dictates that school personnel “should not disclose information that may reveal a student’s transgender status or gender nonconforming presentation to others, including parents.”

The Education Department expressed its disappointment with the district’s continued non-compliance. “Despite the Department’s proposed Resolution Agreement, which outlined specific actions the District should take to remedy their FERPA violations, the District continues to ignore federal parental rights law,” the department stated.

This is not an isolated incident, as the administration has previously threatened to pull federal funding from other school districts across the nation due to their policies regarding transgender students.

Earlier this year, the Education Department had already identified policies concerning transgender students in four Kansas school districts, including Kansas City and Kansas Public Schools, as being in violation of federal law.

The broader context includes President Donald Trump’s executive order aimed at preventing transgender women and girls from participating in girls’ and women’s sports. Additionally, the U.S. Supreme Court recently made a ruling allowing states to prohibit transgender women and girls from competing in women’s sports. This ruling upheld laws in Idaho and West Virginia, while not mandating similar bans in states that do not currently have them.
