The civil lawsuit, officially lodged in the Northern District of California, specifically names Tang Tan, OpenAI’s Chief Hardware Officer, and Chang Liu, a technical staffer at the company, as defendants. Apple asserts that both individuals, who were formerly employed by Apple, misappropriated proprietary information to aid OpenAI in the development of its own hardware.
Furthermore, Apple’s complaint extends beyond individual actions, accusing OpenAI of orchestrating a “coordinated pattern of misconduct at an institutional level.” This suggests a systemic issue within OpenAI, rather than isolated incidents.
The core of Apple’s argument is clearly stated in the complaint: “This case is about Apple’s former employees stealing Apple’s trade secrets for the benefit of OpenAI. Apple brings this suit to put a stop to it.” The company is seeking to halt these alleged practices.
According to the lawsuit, Tan, who spent over two decades at Apple, played a significant role in the design of iconic products such as the iPhone, Apple Watch, and iPod. Liu, a former electrical engineer at Apple for eight years, reportedly had access to some of the most sensitive product development information held by the technology giant.
In response to the allegations, an Apple spokesperson issued a statement on Friday, emphasizing the company’s commitment to protecting its employees’ work. “We will always defend our teams’ hard work and innovations, and we are taking all appropriate steps to do so,” the statement read.
OpenAI has not yet disclosed the specific types of products it is developing to support its AI software. However, the company has indicated that it is exploring novel ways for users to interact with AI, moving beyond “traditional products and interfaces” as it ventures into the realm of physical products.

The suit describes OpenAI’s emerging hardware business as being built on “the shakiest of foundations, rotten to its core by its illegal reliance on misappropriated trade secrets.” This strong language underscores the severity of Apple’s accusations.
Apple also stated that it had attempted to engage with OpenAI to discuss its concerns regarding the alleged acquisition of confidential information. However, the company claims that OpenAI failed to respond to these overtures.
“This lawsuit and the discovery process are needed to expose and begin to remedy the pervasive theft of Apple’s trade secrets,” the complaint asserts. Apple views the legal proceedings as essential for uncovering and addressing the alleged widespread misappropriation of its intellectual property.
