SouthernWorldwide.com – The chief prosecutor of the International Criminal Court (ICC) has been suspended with immediate effect. This decision follows a sexual misconduct investigation, leading the court’s governing body to refer disciplinary proceedings against him to member states.
The ICC, headquartered in The Hague, is an international court established by the Rome Statute. Its mandate is to prosecute individuals accused of genocide, war crimes, crimes against humanity, and the crime of aggression when national courts are unable or unwilling to do so.
Karim Khan, the suspended prosecutor, became a highly controversial figure after seeking arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Israeli Defense Minister Yoav Gallant. These actions were related to Israel’s war against Hamas in Gaza. The suspension is a significant development that extends beyond the court’s internal affairs.
It is important to note that Israel and the United States do not recognize the ICC’s jurisdiction and are not member states of the court.
The Bureau of the Assembly of States Parties to the Rome Statute made the decision to refer the disciplinary proceedings against Prosecutor Karim Khan to the full Assembly. He has been suspended from his duties pending a final decision, and a special session will be convened to address the matter, according to a statement from the International Criminal Court’s Presidency.
The court’s presidency has respectfully urged the Assembly of States Parties to conclude this process with the highest priority.
Khan, who has consistently denied any wrongdoing, was at the forefront of the court’s contentious move to seek arrest warrants against Netanyahu and Gallant. These warrants were issued in relation to actions during Israel’s conflict in Gaza.
Khan’s suspension comes after an 18-month investigation into allegations of sexual misconduct involving a lawyer within his office. The allegations have cast a shadow over his leadership.
Lawyers representing Khan have vehemently denied the allegations. They have described the decision to suspend him as “unlawful, procedurally unfair and unsupported by evidence.”
The findings from the investigation have undergone several layers of review. A United Nations Office of Internal Oversight Services investigation reportedly found evidence that supported the allegations of misconduct.
However, a separate judicial review concluded that the evidence presented was not sufficient to prove misconduct beyond a reasonable doubt. This distinction has played a role in the subsequent proceedings.
Despite the differing conclusions, the Assembly of States Parties Bureau, which oversees the court on behalf of its member states, determined that Khan had engaged in serious misconduct involving nonconsensual sexual activity. This led to a recommendation for his removal from office.
The disciplinary probe itself found that Khan had committed “serious misconduct” and a “serious breach of duty.” These findings were reported by The Associated Press.
The case now progresses to a special session of the Assembly of States Parties, which serves as the ICC’s 125-member governing body. The ultimate decision regarding Khan’s future at the court rests with this assembly. A date for the special session has not yet been set.
The International Criminal Court had issued arrest warrants for Prime Minister Netanyahu and Minister Gallant in November 2024. This followed Khan’s request for the warrants several months prior. Both Israel and the United States strongly condemned this action, accusing the court of equating Israeli leaders with Hamas terrorists.
During the Trump administration, sanctions were imposed on Khan in February 2025. These sanctions were enacted over the court’s actions targeting Israeli officials, under an executive order aimed at ICC officials involved in actions against the U.S. or its allies. The order included provisions for asset freezes and U.S. entry restrictions, and the Treasury Department subsequently added Khan to its sanctions list.
A U.S. representative, Waltz, stated, “We oppose any overreach by the ICC against the United States or our allies. Period. And we expect our partners to stand shoulder-to-shoulder with us against these outrageous actions.”
Waltz indicated that the U.S. is closely monitoring the disciplinary proceedings against Khan but declined to comment on the specific details of the case as it unfolds.
He further commented on the situation, noting, “As for the situation with Prosecutor Karim Khan, this is a bit rich that this prosecutor sought to jail a democratically elected prime minister and now we are tracking his immediate suspension and the ongoing disciplinary proceedings. Of course, we aren’t going to comment on the specifics of that case while it plays out.”
The suspension of Karim Khan has elicited immediate reactions from Israeli officials. They have argued that this decision further weakens the court’s case against Netanyahu and Gallant.
Prime Minister Netanyahu himself posted on X, stating, “Want to divert attention from sex crime accusations? Just make up war crime accusations against Israel! Classic. The ICC is corrupt to the core.”
Another Israeli official, Danon, commented, “The International Criminal Court’s decision to immediately suspend the Chief Prosecutor in The Hague, Karim Khan, following the UN investigation, proves that this body is rotten to the core. Now is the time to cancel the absurd indictments against Prime Minister Netanyahu!”
Bayefsky offered a critical perspective, stating, “The astounding story of the world’s International Criminal Court and its lead prosecutor headed by a criminal, an allegedly rapist, is not just about one rotten apple. The entire ICC machine let the process to hold Khan to account drag on for two years after his crimes were first reported.”
Bayefsky argued that the court’s previous actions against Israeli officials should now be subject to renewed scrutiny in light of these developments.
He further asserted, “ICC judges decided that Khan’s efforts to criminalize Israel’s Prime Minister and Defense Minister weren’t tainted by the clear evidence that Khan was trying desperately to use his attack on Israelis to save himself. Khan has taken the credibility of the whole shameful ICC apparatus down with him.”
The Presidency of the International Criminal Court affirmed its commitment to “independent and impartial proceedings.” It also reiterated its dedication to recognition and redress for victims of mass atrocities, as well as upholding the “dignity, rights and aspirations” of court personnel.
The statement also aimed to defend the institution of the ICC itself. It described the court as “one of the most significant achievements of human civilisation” and emphasized its duty to protect “the proper functioning of the Court as a whole and its reputation,” the integrity of judicial proceedings, the rights of both victims and suspects, and the well-being of court staff.
The court’s statement did not specify whether Khan’s suspension would have any impact on the ongoing cases involving Prime Minister Netanyahu and Minister Gallant.
