GOP Bills Seek Stricter Election Donation Rules Amidst ActBlue Scrutiny

SouthernWorldwide.com – Following increased scrutiny of a prominent Democratic fundraising platform, Republican lawmakers have introduced new legislation aimed at enhancing transparency and security in campaign finance, particularly concerning online donations.

House Administration Committee Chairman Bryan Steil, R-Wis., unveiled a legislative package on Monday designed to address these concerns. This package comprises two key bills: The Campaign Finance Transparency Act and the Preventing Foreign Influence in American Elections Act.

The Campaign Finance Transparency Act seeks to implement a series of new transparency regulations for organizations that process political donations. This includes platforms like ActBlue, which has been at the center of recent controversies.

The second bill, the Preventing Foreign Influence in American Elections Act, aims to prevent foreign nationals from funding election-related activities through avenues other than direct campaign contributions.

A spokesperson for Chairman Steil confirmed that the committee plans to expedite the consideration of these bills. This suggests a proactive approach to addressing the perceived vulnerabilities in the current campaign finance system.

“My investigation into ActBlue has demonstrated that the current campaign finance laws weren’t drafted for the modern era we live in,” Congressman Steil stated in an interview. He highlighted that significant loopholes are being exploited by fraudsters and foreign nationals to make illegal political donations.

Steil elaborated on the ease with which fraudulent donations can be made online, emphasizing that individuals can easily use someone else’s name and avoid detection. He described this as an “unacceptable vulnerability” that is being taken advantage of by malicious actors.

The scrutiny on ActBlue intensified following an April report by The New York Times. This report, citing leaked internal memos, suggested that ActBlue’s legal counsel had warned that the platform might have misled Congress regarding its efforts to prevent foreign nationals from donating to American politicians.

One of the memos reportedly stated that ActBlue could be accused of accepting or facilitating foreign-national contributions into American elections. Furthermore, it suggested that because ActBlue’s staff was aware of the system’s limitations, these violations could be deemed “knowing and willful.”

Such a designation could significantly increase penalties sought by the Federal Election Commission (FEC) and grant the Justice Department jurisdiction for a potential criminal investigation. Fox News Digital has not independently verified the content of these memos.

ActBlue has denied any wrongdoing, asserting that its statements to Congress were thoroughly reviewed by legal counsel before submission. The platform has characterized the Republican inquiries as partisan in nature.

The proposed legislation would also affect WinRed, the conservative counterpart to ActBlue. An Associated Press investigation in May 2025 found instances where Trump’s campaign reported citizenship as “verified” for donors living abroad who contributed through WinRed.

Both WinRed and ActBlue did not respond to requests for comment regarding the new legislative proposals. This lack of immediate response leaves the public without their direct input on the proposed changes.

Republicans have long voiced concerns that the use of gift cards for political donations facilitates the concealment of identities, thereby enabling illegal contributions. ActBlue’s lawyers, according to the memos, also indicated that the platform sometimes failed to collect necessary verification documents from foreign-based donors.

The Campaign Finance Transparency Act, as proposed by Steil, aims to prohibit political donations made using gift cards. It would also mandate that the name on a credit or debit card must match that of the campaign donor.

Furthermore, the bill requires verification of citizenship or permanent resident status for donors who do not have an American mailing address. This aims to create a more robust verification process for all donors.

ActBlue, in a letter to Congress in April, stated that it no longer processes donations originating from outside the United States. Previously, the platform required foreign donors to input their passport number when making donations via credit or debit cards.

Beyond direct campaign contributions, conservatives have also raised concerns about foreign influence in American elections through other means. These include activities such as ballot harvesting and voter registration initiatives.

Steil’s Preventing Foreign Influence in American Elections Act seeks to specifically address these concerns. It aims to prevent foreign donors from funding election-related activities that could influence electoral outcomes.

The bill would also prohibit foreign nationals from contributing to the administration of state or local elections. This broadens the scope of prevention beyond direct campaign funding.

ActBlue has actively pushed back against its conservative critics. The platform recently filed a lawsuit against Texas Attorney General Ken Paxton, who is investigating the company.

ActBlue alleges in its lawsuit that Paxton is abusing his office by pursuing a politically motivated legal action against the company. The lawsuit was filed on May 1st.

The district judge overseeing the case has indicated a preliminary view that ActBlue is likely to prevail on at least some aspects of its legal complaint. This complaint accuses Paxton of violating ActBlue’s First Amendment rights by allegedly targeting it for engaging in constitutionally protected political activity.
