The Supreme Court’s order, issued on a Thursday, effectively preserves the current Food and Drug Administration (FDA) regulations. These regulations permit patients to obtain mifepristone without requiring an in-person consultation with a doctor.
This move was not unanimous, as Justice Clarence Thomas dissented from the court’s decision. Justice Samuel Alito also filed a separate dissenting opinion.

The legal dispute originated from challenges to the FDA’s modifications made in 2023. These changes expanded the accessibility of mifepristone, notably by allowing it to be prescribed via telehealth and delivered through the mail.
