SouthernWorldwide.com – A lawsuit has been filed against Outback Steakhouse seeking $1.5 million in damages. The claim stems from an incident where a woman alleges she slipped and fell on mashed potatoes at one of the restaurant’s locations.
The plaintiff, Tracy Renshaw, a 56-year-old woman, asserts that she sustained severe and enduring injuries as a result of the fall. This incident reportedly occurred in May 2023 at an Outback Steakhouse in Sterling, Virginia.
The lawsuit, which was recently moved to federal court after initially being filed in Loudoun County Circuit Court, contends that Outback Steakhouse is liable. The core of the claim is that the restaurant chain failed to uphold its responsibility to maintain a safe environment for its patrons.
According to Renshaw’s allegations, she was on her way to use the restroom when she encountered a slippery substance on the floor. The lawsuit specifies that this substance appeared to be mashed potatoes, leading to her fall and subsequent impact with the hard floor, landing face-first.
Renshaw claims that the restaurant did not provide adequate warnings to customers regarding the potential fall hazard. Furthermore, she alleges that the spilled food remained on the floor for an excessive period, creating conditions that were “unreasonably dangerous” for diners.
The legal filing states that the chain “breached their duties of care and were negligent in that they allowed a slippery foreign substance to remain on the floor, failed to remove the foreign substance within a reasonable amount of time” and neglected to warn customers about the spill.
As a consequence of the alleged incident, Renshaw claims to have endured considerable pain and incurred substantial medical expenses. She also states that the injuries sustained from the fall have negatively impacted her capacity to work.
