Democrats Silent on Next Moves Following Supreme Court Transgender Sports Decision

SouthernWorldwide.com – Congressional Democrats have remained largely silent regarding their potential next steps following the Supreme Court’s ruling that allows states to prohibit transgender athletes from participating in women’s sports. This ruling highlights a contentious issue that continues to divide the party as the November midterm elections approach.

The Supreme Court’s decision on Tuesday affirmed that states can bar biological males from competing on girls’ and women’s school sports teams. This upholds existing laws in Idaho and West Virginia and effectively supports similar restrictions in 25 other states that base participation on biological sex.

While the ruling was met with approval from Republicans, it does not impact states that continue to permit biological males to compete in women’s sports.

Progressive Democrats voiced strong criticism of the decision. However, the majority of elected officials within the party have not issued public statements, and none have outlined specific legislative responses.

Representative Sarah Jacobs, D-Calif., a member of the House Democratic leadership and co-chair of the Trans Equality Task Force, stated in a social media video, “I want every trans kid to know that there are people here in Congress fighting for you. We are going to stand up for all women and girls, which includes trans women and girls.” She did not specify whether Democrats would introduce legislation in response to the ruling.

The Congressional Equality Caucus, a Democratic group advocating for LGBTQ+ rights, and House Minority Leader Hakeem Jeffries, D-N.Y., also did not detail any legislative plans. The Equality Caucus did, however, post on social media condemning the decision as “devastating” for transgender athletes.

This relatively subdued response from many Democrats comes as public opinion polls consistently show widespread opposition to transgender athletes competing in women’s sports, including among Democrats. This suggests that some lawmakers might be misaligned with their constituents’ views.

A 2025 survey conducted by The New York Times indicated that nearly 80% of Americans oppose biological males competing in women’s sports. The poll also found that approximately 70% of Democrats or those leaning Democrat shared this viewpoint.

Democrats from the centrist wing of the party have been largely quiet about the Supreme Court’s ruling.

Representative Don Davis, D-N.C., who is seeking a third term in a district that leans Republican, issued a statement supportive of the court’s decision. “The U.S. Supreme Court delivered a significant ruling affirming that states possess the legal authority to maintain separate sports teams based on biological sex,” Davis stated. “Title IX has played a vital role in expanding athletic opportunities for women and girls, and we must continue safeguarding those opportunities.”

Representative Marie Gluesenkamp Perez, D-Wash., a prominent target for Republicans in the upcoming midterm elections and a member of the Equality Caucus, acknowledged on Wednesday that the transgender rights movement sometimes overlooks the “nuance” surrounding women’s sports. In an interview with CNN, she commented, “At those town halls, what I saw was that the people who were the most upset, a lot of them had spent the last 12 years driving their girls to sports practice, and they view their best shot of their student getting a college education as an athletic scholarship. And, so, when we rush to moralize and be like, ‘This is all about love vs. hate,’ I think we miss some of the nuance.”

The Washington Democrat did not explicitly state her agreement with the court’s ruling.

Notably absent from public comment on the issue was Senate Minority Leader Chuck Schumer, D-N.Y. On the same day, Schumer had praised the Supreme Court’s decision upholding birthright citizenship and had previously posted about attending New York City’s Pride parade.

However, some of the most vocal supporters of transgender rights in the Senate did express their views, vowing to “keep fighting” for transgender athletes.

Senator Ed Markey, D-Mass., an early supporter of LGBTQ+ rights and the introducer of the Trans Bill of Rights, charged that the court’s decision “again cleared the way for Trump and MAGA Republicans to discriminate against the trans community.” He stated on X, “This decision tears trans athletes from their teams and the sports they love. We will keep fighting. Discrimination and hate will not win.”

Senator Elizabeth Warren, D-Mass., also weighed in, accusing “right-wing extremists and the MAGA movement” of being “determined to single out, target, and harm the trans community.” She added on X, “My heart is with trans kids and their loved ones. I won’t stop fighting for them.”
