SouthernWorldwide.com – Former President Donald Trump has publicly criticized President Joe Biden, calling him a “Crooked Politician!!!” following Biden’s decision to sue the Justice Department. This legal action by Biden aims to prevent the release of audio recordings and transcripts related to the special counsel investigation into his handling of classified documents.
Trump shared an article detailing Biden’s lawsuit on his Truth Social platform, expressing his strong disapproval of the move. The lawsuit was filed on Tuesday, with Biden’s legal team seeking to block the Justice Department from releasing recordings and transcripts of his interview with ghostwriter Mark Zwonitzer. These materials were gathered by special counsel Robert Hur during his investigation.
According to the lawsuit, Biden’s lawyers contend that the Justice Department’s plan to share these files with Congress and the conservative Heritage Foundation is inappropriate. They had previously argued that these records were exempt from disclosure under federal public records law.
The core of the legal argument from Biden’s attorneys is that the disclosure of these recordings would represent an “unwarranted invasion of President Biden’s privacy.” They asserted that every American, including current or former Vice Presidents, has a right to privacy in their personal conversations within their own homes.
Furthermore, Biden’s legal team stated that when the Department of Justice obtains such private information through a criminal investigation, it carries a specific responsibility to safeguard it from public disclosure. The recordings in question stem from interviews Biden had with Zwonitzer at his home in 2016 and 2017. Zwonitzer had collaborated with Biden on his two memoirs.
These audio recordings and their accompanying transcripts were a significant part of Robert Hur’s investigation. The probe focused on Biden’s alleged improper retention of classified documents from his tenure as a senator and vice president.
The year-long investigation concluded with a 345-page report from Hur. While the report raised questions about Biden’s age and mental competence, it ultimately recommended no criminal charges against the then-81-year-old president. Hur cited insufficient evidence to pursue a successful prosecution in court.
Separately, Biden has been contesting the release of audio from his interview with Special Counsel Hur himself. In 2024, the House of Representatives voted to hold then-Attorney General Merrick Garland in contempt of Congress for refusing to provide this audio. The White House had asserted executive privilege over these recordings.
Transcripts from Biden’s interviews with federal prosecutors were made public last year. During these interviews, Biden maintained that he handled classified information with seriousness. However, the transcripts revealed instances where he appeared to struggle with dates and details, and expressed unfamiliarity with the documentation surrounding some of the sensitive documents he possessed.

Republicans have argued that Biden has received preferential treatment from his own Justice Department, contrasting it with the legal actions taken against Trump. They believe Trump has been unfairly targeted by prosecutors. Democrats, on the other hand, have highlighted Biden’s cooperation with investigators. They often draw a distinction between Biden’s case and the criminal charges against Trump, who is accused of failing to return classified documents requested by the National Archives from his Florida estate.
